Terms & Conditions

Welcome to www.amatratravel.com ("Website"). The domain name of the Website is owned by Amatra Travel Private Limited (“we/ us/ our/ AT”), a company incorporated under the provisions of the Companies Act, 1956.

The customer’s (“you/ your/ traveller”) use of the Website, services and tools are governed by the following terms and conditions ("Terms of Use") including the applicable policies which are incorporated herein by way of reference and constitutes a valid agreement between you and AT. If you transact on the Website , you shall be subject to the policies that are applicable, as displayed on the Website for such transaction. Your use of this Website constitutes your binding obligation and agreement to all such terms, conditions, and notices which are subject to amendment without any notice by AT. Any usage of the Website is subject to the following Terms of Use:

1. Booking your Holiday
  • Your contract in respect of your holiday is made with Elite Travel & Tourism (‘the Company‘), registered in Oman and all bookings are subject to these terms and conditions.
  • All communications by the Company in relation to your holiday will be sent to the address stated on the booking form.
  • All bookings must be made through an authorised representative of the Company. At the time of booking the Company booking form must be completed and submitted together with a deposit of 50% of the total cost of the booking.
  • Receipt of the deposit and booking form by the Company does neither guarantee nor imply confirmation of the booking. No booking shall be confirmed until the Company issues a written notice. The Company reserves the right to refuse a booking without giving any reason and shall in that event return any deposit received.
  • Your holiday must be paid in full at least 30 days before the departure date. If payment is not received by the due date, the Company reserves the right to cancel the booking and retain the deposit. The person who signs the booking form guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure the Company receives payment in full by the due date. No reminders will be sent.
  • If you book within 30 days of your departure date payment must be made in full at the time of booking.
  • All special requests, such as dietary requirements, should be noted on the booking form.
  • The Company will provide the service as set out and confirmed in writing.
Price Policy
  • The Company is under no obligation to furnish a breakdown of the costs involved in a holiday.
  • The Company reserves the right to notify you of any increase in price before accepting your booking.
  • After a Confirmation Invoice has been issued, unless you choose to pay for your holiday in full at the time of booking, the price of your holiday is subject to the possibilities of surcharges in certain limited circumstances. However, a surcharge will only be levied to allow for variations in transportation cost, including cost of fuel, increase in normal published airfares, taxes or fees chargeable for services such as landing taxes at airports, the exchange rate applied to the particular package or if the government or regulatory body introduce an increase of taxes. Even then, the Company will absorb an amount equal to 2% of your holiday price (excluding insurance premiums and amendment charges) before passing on any surcharge to you. Only amounts in excess of this 2% will be surcharged. Surcharges will be notified by a revised Confirmation Invoice sent to you.
  • If a surcharge would increase the total holiday price shown on your original Confirmation Invoice by 10% or more, you may cancel your booking within 14 days of the date of issue of the revised Invoice and obtain a full refund of all payments made to the Company and any amendment charges previously incurred.
  • Optionally, you may choose to pay for your holiday in full at the time of booking, in which case your holiday price will be fixed at the cost quoted by the Company at the time. To qualify for this benefit you should return the Confirmation Invoice to the Company with full payment to reach the Company within 7 days of the date printed on the Confirmation Invoice.
Travel insurance

It is essential that you have adequate and appropriate cover for your trip including any adventurous activities such as trekking at altitude. Note that the majority of our trips do not require the use of climbing ropes and are all supervised. It is important to have adequate insurance which will cover cancellation costs from the date of booking as well as medical expenses (including evacuation and repatriation). If you travel against FCO advice, the validity of your insurance policy may be affected. Please read your policy details carefully and take them with you on your trip. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

Health

Except as disclosed in your medical questionnaire, you are taken to confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the trip, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the trip, taking into account its challenges and purposes. If you are unable to give for this confirmation for any reason or have any medical condition or disability which may affect your trip, you must contact us before you submit your application form so that we can assist you in considering the suitability of the trip for you.

POLICY REGARDING CANCELLATION / NO SHOW / EARLY DEPARTURE :

In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s we must be informed in writing. Cancellation charges would be effective from the date we receive letter in writing and cancellation charges would be as follows :

  • 60 days & prior to arrival - 10% of the tour/service cost
  • 59 days to 30 days prior to arrival - 20% of the tour/service cost
  • 29 days to 15 days prior to arrival - 25% of the tour/service cost
  • 14 days to 08 days prior to arrival - 50% of the tour/service cost
  • 07 days & less, prior to arrival or no show - NO REFUND.
Please note

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 4 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.

LIABILITY

Once the Client book through Amatra Travels, he/she agrees to be legally bound by the following terms and conditions.Amatra Travels acts in good faith, acting solely as an intermediary and an agent for vendors and service providers (i.e Air and Sea Carriage, Hotel accommodation, Ground transportation, Tours, Meals, Cruises, Travel Insurance, etc.) and as such, it is not liable for breach of contract or any intentional or careless actions or omissions on part of suppliers, which may result in any loss, damage, delay, injury, death, sickness, or accident sustained by the client and his travel companions in the course of availing the indicated services.This agency likewise shall not be responsible for any injuries, damages, losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, schedule changes caused by weather or road conditions, force majeure such as natural catastrophes, strikes, abnormal conditions or developments, or any other irregularities, actions, omissions or conditions outside the travel agent’s reasonable control.By embarking upon this travel, Travelers (CLIENT/CUSTOMER) voluntarily assume all risks involved with such travel, whether expected or unexpected.Luggage is at the owner’s risk throughout the tour. The fees for the use of porters are shouldered by the clients. All information on Amatra Travels website is subject to change and we reserve the right to correct any mistakes that may appear on our website. These general booking conditions are subject to change and we reserve the right to update these conditions without notice.

DISCLAIMER

The company and its agents and representatives are not responsible and expressly exclude liability for any injury, illness, damage, loss, delay, accident or irregularities that maybe caused to a person or property and all bookings are subject to the usual terms and conditions and contract of the owner or operator of the services involved. The transportation companies shall be exempted from all liability in respect of any detention, delay, loss, danger, sickness or injury caused and of whatever kind occurring to the passengers at any time whilst the passengers are not on board a carrier of conveyance used or operated by transportation by the companies or firms. The company does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by events which are beyond its control or which are not preventable by reasonable diligence on its part including but not limited to war, civil disturbances, fire, floods, unusually severe weather, acts of god, act of government or of any authorities, accidents to or failure of machinery or equipment or industrial action.

All claims against the company must be made in writing within 30 days after the completion of the tour.

All terms and conditions mentioned above cannot be altered or waived and enquiries pertaining to this document may be made to Amatra Travels Legal Department.

The company shall advise and if needed, assist you with regards to any claims against any party in your tour. Amatra Travels Sdn Bhd shall ensure that the collection, use and disclosure of your personal data is consistent with the Personal Data Protection Act 2010 (‘PDPA’). It is acknowledged that personal data collected and processed is obtained voluntarily and with your consent.
